1. Who We Are
VitaWild is a hydration and wellness brand operated by LYTNG, LLC d/b/a VitaWild (“VitaWild,” “we,” “us,” or “our”), 8276 Ronson Road, San Diego, California 92111, United States.
This Privacy Policy applies to our website at www.vitawild.co, our checkout and customer account experience, our emails and text messages, our customer support channels, and our promotions and giveaways (together, the “Services”). It does not apply to purchases you make from us on third-party marketplaces such as Amazon, which are governed by that marketplace’s privacy practices in addition to ours.
By using the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy.
2. Information We Collect
(a) Information you give us directly
- Contact details — your name, email address, phone number, and shipping and billing address.
- Order information — the products you purchase, order value, discount codes used, and delivery details. Payment card details are collected and processed by our payment processors; we do not store full card numbers.
- Account and subscription information — login details, subscription plan, delivery frequency, and order history.
- Communications — anything you send us through customer support, email, text, surveys, or social media.
- Reviews and user content — reviews, photos, and other content you choose to submit.
- Promotion entries — information you submit to enter a giveaway or promotion, such as your name, email address, and state of residence.
(b) Information collected automatically
- Device and usage data — IP address, browser and device type, operating system, pages viewed, products viewed and added to cart, referring URLs and the ads or links that brought you to the site, and the dates and times of your visits.
- Site interaction data — we use analytics tools, including session replay and heatmap tools, that record how visitors interact with our pages (clicks, scrolling, and navigation). These recordings are used to improve the site and are not used to capture payment card entries or passwords.
This data is collected using cookies, pixels, and similar technologies described in Section 4.
(c) Information from third parties
- Our ecommerce platform, payment processors, and fulfillment partners (order, payment, and delivery confirmations).
- Advertising and analytics partners (information about how our ads perform and how you arrived at our site).
- Referral, affiliate, and creator partners (that you clicked a partner’s link or used a partner’s code).
3. How We Use Information
- Providing the Services — processing and fulfilling orders, managing subscriptions and renewals, processing payments and refunds, providing customer support, and maintaining your account.
- Marketing and advertising — sending marketing emails and (with your consent) text messages, showing you ads for our products on other sites and platforms, and measuring how our marketing performs.
- Improving the Services — analytics, site testing, product development, and understanding how customers use the site.
- Promotions — administering giveaways and promotions, selecting and notifying winners, and delivering prizes.
- Security and fraud prevention — detecting and preventing fraudulent transactions, abuse of promotions or guarantees, and threats to the Services.
- Legal compliance — complying with applicable law, responding to lawful requests, tax and accounting obligations, and enforcing our Terms of Service.
4. Cookies & Tracking Technologies
Like most ecommerce sites, we use cookies, pixels, tags, and similar technologies. Some are set by us and some by third parties acting on our behalf. They fall into four buckets:
- Essential — required for the site, cart, and checkout to function.
- Performance and analytics — help us understand site traffic and behavior, including the session replay tools described in Section 2(b).
- Functional — remember your preferences, such as items left in your cart.
- Advertising — set by advertising partners such as Meta and Google to show you relevant ads on other sites and apps and to measure ad performance.
You can control cookies through your browser settings, and you can opt out of advertising cookies as described in Section 8. Blocking essential cookies may break parts of the site.
Some browsers transmit “Do Not Track” signals; because there is no accepted standard for them, we do not respond to Do Not Track signals. We do honor opt-out preference signals such as Global Privacy Control where required by law, as described in Section 8.
5. Advertising & Analytics
We work with advertising platforms — including Meta (Facebook and Instagram) and Google — and with analytics providers to advertise our products and measure results. These partners may collect information about your visits to our site through cookies and pixels and combine it with information they hold about you to show you our ads elsewhere.
Under some state privacy laws, this kind of disclosure for cross-context or targeted advertising is treated as a “sale” or “sharing” of personal information. In the preceding 12 months we have “sold” or “shared” (as those terms are defined by those laws) identifiers, device and internet activity information, and commercial information (such as products viewed or purchased) with advertising partners for this purpose. We do not sell personal information for money, and we do not knowingly sell or share the personal information of anyone under 16.
You can opt out of this at any time — see Section 8.
6. How We Disclose Information
We disclose personal information to the following categories of recipients:
- Ecommerce platform — our store, checkout, and customer accounts run on Shopify.
- Payment processors — to process your payments securely.
- Subscription management — the platform that powers our subscription plans, renewals, and customer portal.
- Fulfillment and delivery — the warehouse and shipping carriers that pack and deliver your orders.
- Email and SMS provider — the platform that sends our marketing and transactional emails and text messages (currently Klaviyo).
- Customer support — the helpdesk platform we use to answer your messages.
- Analytics and advertising partners — as described in Sections 4 and 5.
- Professional advisors — lawyers, accountants, auditors, and insurers, where needed.
- Legal and safety — when required by law, subpoena, or legal process, or to protect the rights, safety, or property of VitaWild, our customers, or others.
- Business transfers — in connection with a merger, acquisition, financing, or sale of all or part of our business, in which case your information may be transferred as part of that transaction.
Service providers listed above are permitted to use your information only to provide services to us. We do not disclose personal information to unrelated third parties for their own independent marketing except as described in Section 5.
7. Email & Text Messages
Email. If you make a purchase or sign up for our list, we may send you marketing emails. You can unsubscribe at any time using the link at the bottom of any marketing email. You will still receive transactional emails about your orders and account.
Text messages. If you opt in to our text program, we send recurring marketing and order-related messages from +1 (844) 460-1456. Consent to receive texts is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to cancel at any time or HELP for help. The full text-program terms are in Section 9 of our Terms of Service.
8. Your Privacy Rights
Depending on where you live, state privacy laws (including the California Consumer Privacy Act and similar laws in Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and other states) may give you some or all of the following rights:
- Right to know / access — request a copy of the personal information we hold about you and information about how we use and disclose it.
- Right to delete — request that we delete your personal information, subject to legal exceptions (for example, records we must keep for tax or fraud-prevention purposes).
- Right to correct — request that we fix inaccurate personal information.
- Right to opt out — opt out of the “sale” or “sharing” of your personal information and of targeted advertising.
- Right to portability — receive your information in a portable format.
- Right to non-discrimination — we will not deny you products, charge you different prices, or provide a different level of service because you exercised a privacy right.
How to exercise your rights
- Email us at support@vitawild.co with the subject line “Privacy Request,” telling us which right you want to exercise.
- To opt out of sale/sharing and targeted advertising, you may also use a legally recognized opt-out preference signal such as Global Privacy Control (GPC) in your browser; we honor these signals where required by law.
We may need to verify your identity before fulfilling a request — typically by matching the email address on your request to the one on your account or orders. You may use an authorized agent to submit a request on your behalf; we will require proof of the agent’s authority. If we decline a request, you may appeal by replying to our decision, and where your state provides it, you may also contact your state attorney general.
We do not use or disclose sensitive personal information for purposes that require a “right to limit” under California law.
9. Children
The Services are intended for adults 18 and older. We do not knowingly collect personal information from children, and we do not knowingly sell or share the personal information of consumers under 16 years of age. If you believe a child has provided us personal information, contact us at support@vitawild.co and we will delete it.
10. Data Retention
We keep personal information for as long as needed for the purposes described in this policy — generally, for as long as you have an account or active subscription with us, and afterward as needed to comply with our legal obligations (such as tax and accounting rules), resolve disputes, prevent fraud and abuse, and enforce our agreements. When information is no longer needed, we delete it or de-identify it.
11. Security
We use commercially reasonable technical and organizational safeguards designed to protect your personal information, including encrypted checkout and restricted access to customer data. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affecting your information occurs, we will notify you as required by law.
12. United States Only
The Services are operated from the United States and are intended for customers in the United States. Your information is processed and stored in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those of your jurisdiction.
13. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or the law. The “Last updated” date at the top shows the current version. If we make material changes, we will take reasonable steps to notify you — for example, by posting a notice on the site or emailing the address on your account. Your continued use of the Services after an update means the updated policy applies to you.
